SERVICES TERMS AND CONDITIONS
Digi Khata (Private) Limited (the “Company”) operates a web/mobile application, “DigiKhata App” (the
“Application”) available on Google Play Store, iOS and other similar platforms and also operates a
website https://digiKhata.pk (the “Website”) . The App and the Website
shall be together referred to as the “Platform”.
EASYPAISA-ENABLED SERVICES
These Terms and Conditions shall govern your use of the Telenor Microfinance Bank Limited Easypaisa
Services (hereinafter referred to as the “Easypaisa Services”) on the Platform. By accepting these Terms
and Conditions you agree to bind yourself to use the Easypaisa Services provided in the Platform as per
the terms and conditions listed herein. You understand that these terms and conditions only govern the
use of the Easypaisa Services. By continuing to use the Platform and the Easypaisa Services on the
Platform, you agree to the general terms and conditions of use of the Platform of the Company as well
and these Terms and Conditions are not a replacement/substitute for the same.
These Terms constitute a binding and enforceable legal contract between the Company and you. You
represent and warrant that you (a) have full legal capacity and authority to agree and bind yourself to
these Terms, (b) are 18 (eighteen) years of age or older, and (c) are a Pakistani resident. If you
represent an entity, organization, or any other legal person, you confirm and represent that you have
the necessary power and authority to bind such entity, organization, or legal person to these
Terms.
The Company reserves the right to make changes to these Terms by posting the new/updated version and your
continued use and/or non-deletion of the Platform shall indicate your agreement to such changes.
Accordingly, we encourage you to kindly continue to review the Terms whenever accessing or using the
Platform so as to be abreast with the changes that we may be carrying out to these Terms.
By accepting these Terms and Conditions you undertake and agree to the following:
- You hereby provide to Digi Khata express consent to use Easypaisa Services on the Platform in
accordance with the general Terms and Conditions and these Terms governing the Easypaisa enabled
services and the Telenor Microfinance Bank Limited terms governing the Easypaisa transactions;
- All customer support with regard to any/all of Easypaisa Services shall be provided by Digi Khata
and all queries must be sent to [email protected]. Digi
Khata shall in turn endeavour and use all reasonable efforts to resolve any queries to extend
support to its Users;
- It is hereby stated that Easypaisa Services are not directly being provided by Digi Khata.
Easypaisa Services are being offered to the Users through a Third Party Service Provider, i.e.,
Telenor Microfinance Bank Limited. Digi Khata holds no liability on behalf of Telenor Microfinance
Bank Limited, or the User, for any transactions which the Users make using the Easypaisa Services
through the Platform;
- Digi Khata holds no responsibility and liability in case a wrong/false transaction is carried out
using the Easypaisa Services. Digi Khata shall only be extending support to its Users to ensure that
any matters/disputes are resolved between the Users and the Telenor Microfinance Bank Limited;
- In case of any reversal of transactions, the User shall and must inform Digi Khata at the
earliest. Digi Khata shall upon such provision of information, liaison with the Telenor Microfinance
Bank Limited to have the transaction reversed, provided the transaction is allowed under the Telenor
Microfinance Bank Limited’s Easypaisa Services policy;
- Neither Digi Khata nor the Telenor Microfinance Bank Limited shall be held liable in case the
Users fail to provide the correct details for any transaction they may have conducted using the
Platform related to Easypaisa Services;
- The Users hereby understand that Easypaisa Services may only be undertaken by and amongst Users
who have an Easypaisa account already with the Telenor Microfinance Bank Limited in good standing;
- Using and operating an Easypaisa account and availing the Easypaisa Services shall be governed by
these Terms and Conditions and the Telenor Microfinance Bank Limited’s policies governing Easypaisa
transactions. Digi Khata and the Telenor Microfinance Bank Limited hold the right to refuse any
transaction if it violates any of these terms, Telenor Microfinance Bank Limited’s terms of
Easypaisa transactions or the general terms and conditions to use the Platform;
- In case any refund or charges are due to the Telenor Microfinance Bank Limited upon your usage of
the Easypaisa Services, you undertake to make such payments to the Telenor Microfinance Bank Limited
immediately. Your usage of any of the Easypaisa Services or the use of the Platform may be suspended
or blocked immediately, without any prior notice, in case you fail to make such payments to the
Telenor Microfinance Bank Limited immediately when due, until such payments are settled. Digi Khata
holds no responsibility or liability for any charges that you may owe to the Telenor Microfinance
Bank Limited;
- Any and all confirmations regarding transactions shall be received by the Users through Telenor
Microfinance Bank Limited, directly, at details provided by the Users to Telenor Microfinance Bank
Limited against the Users’ CNIC details with the Telenor Microfinance Bank Limited;
- While availing any of the Easypaisa Services through the Platform, Digi Khata may ask the Users
to provide identity documents which may be required by the Telenor Microfinance Bank Limited. The
Users undertake to provide true and correct information at all times. Provision of any false
information may result in the Easypaisa Services and any other services being offered in the
Platform to be suspended or terminated, immediately, without any notice to the Users;
- The Users understand that the Easypaisa Services are services being offered through the Platform
by Digi Khata to its Users on behalf of the Telenor Microfinance Bank Limited and that Digi Khata in
itself is not conducting/collecting/reversing any transactions itself. The Easypaisa Services are
solely being provided through the Platform by the Telenor Microfinance Bank Limited;
- We are not responsible for any loss of funds if you give incorrect instructions or if your
payment instructions are not given sufficiently in advance to allow for timely delivery of your
Payment. You represent and warrant that all Payments you make comply with applicable law of the
land.
- Except as otherwise expressly provided herein, and without limiting any other provisions of
these Terms, Digi Khata will not be liable if we fail to send, or delay the transmission of, funds
to a designated business or User through the Easypaisa Service if: (i) you have insufficient funds
available to complete the Payment in your Easypaisa Account; (ii) we or the Telenor Microfinance
Bank Limited believe the Payment may violate applicable law or these Terms; (iii) we or the Telenor
Microfinance Bank Limited identify a security risk involving the Payment or the Payments Service;
(iv) circumstances beyond our control (such as fire, flood, terrorist attack, or national emergency)
prevent the Payment, despite reasonable precautions that we have taken; (v)We cannot guarantee the
timely delivery of funds as a result of a failure of Telenor Microfinance Bank Limited to act in a
timely manner;
- We are not responsible for the delivery, quality, safety, legality or any other aspect of goods
or services for which payments are made using the Easypaisa Services;
- Digi Khata may at its sole discretion, at any point in time, change its Third Party Service
Provider banking institution;
- You hereby agree to abide by the general terms and conditions of use of the platform as
available on the Company’s Website and the Company’s Application.
